Terms of Service

These Terms of Service ("Terms") govern your use of the managed cloud hosting services provided by Alplink OÜ, registry code [REGISTRY_CODE], registered at Harju maakond, Tallinn, Estonia ("Alplink", "we", "us"). By creating an account or using our services, you agree to these Terms.
1. Definitions
- Service — the managed cloud hosting platform operated by Alplink, including server infrastructure, control panel, backups, monitoring, and support.
- Customer — any individual or legal entity that registers an account and uses the Service.
- Instance — a single deployment of an open-source application (e.g., Odoo, WordPress, Nextcloud, or Matomo) provisioned and managed by Alplink on behalf of the Customer.
- Content — all data, files, databases, configurations, and other materials uploaded, created, or stored by the Customer within an Instance.
2. Service Description
Alplink provides managed hosting of open-source applications on European Union infrastructure. The Service includes:
- Provisioning and management of dedicated server resources for each Instance
- Automated daily backups with 30-day retention
- SSL/TLS certificates for all Instances
- CDN and edge caching via our infrastructure partners
- Application updates and security patches, applied in coordination with the Customer
- Monitoring and incident response during business hours
Alplink does not provide custom application development, end-user support for the hosted applications, or legal/compliance advice.
3. Account & Registration
To use the Service, you must create an account. By registering, you represent that:
- You are at least 18 years old or have the legal capacity to enter into a binding agreement.
- The information you provide is accurate, complete, and current.
- You will maintain only one account per individual or legal entity, unless expressly authorized by Alplink.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Acceptable Use
You agree not to use the Service to:
- Store, distribute, or transmit content that is illegal under Estonian or EU law
- Send unsolicited bulk messages (spam) or operate open mail relays
- Host, distribute, or execute malware, phishing pages, or any malicious software
- Mine cryptocurrency or run computationally abusive workloads
- Consume server resources in a way that degrades the Service for other Customers
- Attempt to gain unauthorized access to other Customers' Instances or Alplink's infrastructure
- Violate the intellectual property rights of any third party
Alplink reserves the right to suspend or terminate Instances that violate this Acceptable Use Policy without prior notice.
5. Payment & Billing
- All prices are listed in EUR and are exclusive of VAT, which will be applied as required by law.
- Billing is monthly, charged in advance on the anniversary of your subscription start date.
- Payments are processed securely via Stripe. By subscribing, you also agree to Stripe's Terms of Service.
- Where applicable, a 14-day free trial may be offered. You will not be charged until the trial period ends. You may cancel at any time during the trial.
- No refunds are issued for partial billing periods. If you cancel mid-cycle, the Service remains active until the end of the current billing period.
- Alplink reserves the right to adjust pricing with at least 30 days' written notice.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy.
- Ownership: You retain full ownership of all Content stored in your Instances. Alplink claims no rights over your Content.
- Processing: Alplink processes Customer data solely to provide the Service, acting as a data processor under GDPR. A Data Processing Agreement (DPA) is available upon request.
- Sub-processors: A list of our sub-processors is available at /sub-processors.
- Data location: All primary data is stored within the European Union.
7. Backups & Data Retention
- Alplink performs automated daily backups of all Instances, retained for 30 days.
- Backups are stored on geographically separate infrastructure within the EU.
- While Alplink takes reasonable care to ensure backup integrity, the Customer is responsible for maintaining independent backups of critical data.
- Backup restoration requests can be submitted through the control panel or by contacting support.
8. Service Level
- Alplink targets 99.9% monthly uptime for all Instances. This is an operational target, not a guaranteed SLA with financial remedies.
- Scheduled maintenance will be communicated at least 48 hours in advance via email and the control panel. Maintenance windows are typically scheduled during low-traffic hours (CET).
- Alplink is not liable for downtime caused by force majeure events, including but not limited to natural disasters, acts of war, government actions, or widespread internet outages.
9. Termination
- By the Customer: You may cancel your subscription at any time with 30 days' notice. The Service will remain active until the end of the current billing period.
- By Alplink: We may terminate your account with 30 days' written notice. We may also suspend or terminate Instances immediately if you violate these Terms or the Acceptable Use Policy.
- Data export: Upon termination, you will have 30 days to export your Content. After this period, all data associated with your account will be permanently deleted.
- Survival: Sections on liability, governing law, and any accrued obligations survive termination.
10. Limitation of Liability
- To the maximum extent permitted by law, Alplink's total aggregate liability for any claims arising out of or related to the Service is limited to the fees paid by the Customer in the 12 months preceding the claim.
- Alplink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- The Service is provided "as is" and "as available". Alplink makes no warranties, express or implied, regarding the Service's fitness for a particular purpose, merchantability, or uninterrupted availability.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from these Terms or the use of the Service shall be resolved in the Harju County Court (Harju Maakohus) in Tallinn, Estonia.
12. Changes to These Terms
Alplink may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or through the control panel. Continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree with the revised Terms, you may terminate your account before the changes take effect.
